These Terms and Conditions ("Terms") constitute a legally binding agreement between you and NextGen Web Solutions Technologies Pvt. Ltd. regarding your access to and use of our website, software applications, and related services ("Services").
Acceptance of Terms
- By accessing or using NextGen Web Solutions products, services, or website, you agree to be bound by these Terms and Conditions.
- If you do not agree to these terms, you must not use our Services.
- We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting.
- Continued use of our Services after changes constitutes acceptance of the updated terms.
Use of Services
- You must be at least 18 years old or have legal capacity to enter into binding contracts.
- You agree to use our Services only for lawful purposes and in accordance with applicable laws.
- You are responsible for maintaining the confidentiality of your account credentials.
- You may not share, sell, or transfer your account access to any third party.
- You agree not to reverse engineer, decompile, or attempt to extract source code from our software.
- You may not use our Services to transmit any viruses, malware, or harmful code.
Billing & Payments
- All prices are listed in Indian Rupees (INR) and are exclusive of applicable taxes unless stated otherwise.
- Subscription fees are charged annually in advance. Payment is due on the subscription start date.
- We accept payments via UPI, credit/debit cards, net banking, and NEFT/RTGS.
- Failed payments may result in service suspension after a 7-day grace period.
- All fees are non-refundable except as specified in our Refund Policy.
- We reserve the right to change pricing with 30 days advance notice.
Termination
- You may cancel your subscription at any time from your account dashboard.
- We may suspend or terminate your account for violation of these terms, fraudulent activity, or non-payment.
- Upon termination, your access to the Services will cease at the end of the current billing period.
- We are not liable for any loss of data after account termination. Please export your data before cancellation.
- Provisions regarding confidentiality, data ownership, and liability shall survive termination.
Intellectual Property
- All software, content, trademarks, and intellectual property rights belong to NextGen Web Solutions Technologies Pvt. Ltd.
- You are granted a limited, non-exclusive, non-transferable license to use our software during your subscription period.
- You may not copy, modify, distribute, or create derivative works from our software without written permission.
- Any feedback or suggestions you provide may be used by us without compensation.
- Third-party integrations are subject to their respective terms of service.
Limitation of Liability
- Our Services are provided "as is" without warranties of any kind, express or implied.
- We do not guarantee uninterrupted, timely, secure, or error-free service.
- In no event shall our total liability exceed the amount you paid for Services in the 12 months preceding the claim.
- We are not liable for indirect, incidental, special, consequential, or punitive damages.
- You agree to indemnify and hold us harmless from claims arising from your use of the Services.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in India, Haryana.
